Actovia Inc. and/or its affiliates (collectively, “Actovia” also referred to as “we” or “us”) have compiled this privacy policy (this “Policy”) to better serve those who are concerned with how their PII is being used online. “Personally Identifiable Information”, or “PII,” as such term is used in US privacy and information securities laws, is information that can be used on its own or together with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read this Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your PII in accordance with our website, any other websites, mobile applications or service offerings that we may use, launch or offer from time to time that links to or references this Policy (each, an “Actovia Property”; collectively, the “Actovia Properties”).

What PII do we collect from OUR ACTOVIA PROPERTIES?

When ordering or registering on any Actovia Property that Actovia shall make available from time to time, as appropriate, you may be asked to enter PII which includes, without limitation, your name, email address, phone number or other details. We request such PII to help assist you with your experience.

When do we collect PII?

We may collect PII from you when you subscribe or enroll on/for any Actovia Property.

How do we use your PII?

We may use the PII we collect from you in order to:

  • Personalize your user experience and to allow us to deliver the type of content and product/service offerings in which you are most interested.
  • Improve the Actovia Properties in order to better serve you.
  • Allow us to better service you in responding to your customer service requests.
  • Send periodic emails regarding your order or other products and services.
  • Allow a user to navigate or browse through our Service quickly and efficiently;
  • In the case of IP addresses, to derive approximate locations of each user, to calculate usage levels, diagnose server problems, and in general to administer the Actovia Properties;
  • Perform data analysis, audits, security and fraud monitoring and prevention; to enhance, improve, or modify our Actovia Properties, or identify usage trends;
  • Aggregate information; See also the section “Aggregated, Anonymized or Statistical Information”.
  • Perform other functions as otherwise described at the time of collection.

How do we protect your PII?

Actovia makes good faith, commercially reasonable efforts to undertake and maintain reasonable and industry-standard security measures to protect the security, confidentiality and integrity of your PII transmitted through or stored via any of our Actovia Properties. More specifically, your PII is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep your PII confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your PII. All transactions are processed through a gateway provider and are not stored or processed on our servers. However, even though Actovia makes reasonable efforts to protect PII (and other forms of information) in its custody, no data storage or transmission over the Internet and no security system is fully secure.  Thus, we cannot guarantee the security of any information we may have collected or received from you or transmitted to you. Do we use Cookies? What are Cookies?

Yes. Cookies are small files that, if you allow it/them, a site or its service provider transfers to your computer’s hard drive through your web browser, which enables that website’s or service provider’s systems to recognize your browser and capture and remember certain information, including PII. For instance, we use cookies to help us remember your session and identify you when visiting Actovia Properties. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to:

  • Help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future on the Websites.
  • Monitor advertisements.
  • Compile aggregated and anonymous data about site traffic and site interactions on the Websites in order to offer better site experiences and tools in the future. We may also use trusted third party services that track this information on our behalf.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Internet Explorer) settings. Each browser is a little different, so look at your browser’s Help menu to learn the correct way to modify your cookies. If you disable cookies, some features on the Websites will be disabled and some of our services may not function properly. However, you can still place orders on the Websites. Please note that while disabling a cookie may prevent the collection of information in the future, it does not prevent the use of information collected before the cookie was disabled.

We along with third-party vendors, such as Google, use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions, and other ad service functions as they relate to the Websites.

AGGREGATE, ANONYMIZED OR STATISTICAL INFORMATION?

Actovia generates and uses aggregated, anonymized, or statistical information about the use of our Actovia Properties. We may provide this information to third parties such as our affiliates, advisers or consultants for research, analytical or strategic purposes. This information is not intended to allow the identification of any specific user of our Actovia Properties.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to outside parties your PII unless we provide you with advance notice. This does not include third-party website hosting partners and other third parties who assist us in operating the Actovia Properties, conducting our business, or servicing you, so long as those parties agree to keep this PII confidential. We may also release your PII when we believe release is appropriate to comply with applicable law, to enforce our policies regarding the Actovia Properties, or protect ours or others’ rights, property, or safety. However, non-PII data that we collect about you may be provided to other parties for marketing, advertising, or other uses.

Third party links

We do not include or offer third party products or services on our website. However, there may be links to outside sources to provide further context and information that Actovia Properties cannot host on our own servers. Navigating to these links are under the sole discretion of the user and we are not responsible for anything the user does on those websites.

Google Integrations

Actovia Properties may use API services from Google that collect information from and write to personal Google accounts that the user chooses. We collect usage information via Google Analytics to monitor the usage of certain pages and products we offer to further improve our applications.
We use Google Recaptcha to prevent bots from interfering with business. Recaptcha may collect data to further improve their AI.
Some Actovia Properties will be using Google Javascript API services (such as and not limited to Maps Geocoding, Streetview, Calendar, Static Maps) in order to improve ease of use and functionality. Some APIs may require the user’s consent to provide access to their data.
Actovia will not sell, trade, or otherwise transfer this PII unless we provide you with advance notice. Data from these services may be used to improve and create new features for Actovia Properties. As a third party vendor, Google may use cookies to monitor data and usage across Actovia Properties.

Google Advertising

We use Google AdSense Advertising on some, if not all of the Actovia Properties. Google’s advertising requirements can be summed up by Google’s Advertising Principles, which are put in place to provide a positive experience for users. As a third party vendor, Google uses cookies to serve ads across the Actovia Properties. Google’s use of the DART cookie enables it to serve ads to our users, however, users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

Please note, we have implemented the following:

  • Remarketing with Google AdSense
  • Demographics and Interests Reporting
  • Google Analytics and Tag Management

Opting out of Google:

Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising initiative opt out page or permanently using the Google Analytics Opt-Out Browser add on.

California Online Privacy Protection Act (“CalOPPA”)

California law requires us to inform California residents who have provided us with PII that they may request of us information about our disclosures to third parties (including affiliated entities) for their direct marketing purposes.  To do so, please contact us as indicated in the “Contact Us” section, and indicate in the subject line “California Privacy Rights”.  We reserve the right not to respond to requests made other than as provided in this section.  In addition, if you are a California resident under the age of 18, and you are a registered user of any Actovia Property, you may request that we remove information you supplied to us by submitting a written request as indicated in the “Contact Us” section.

How does our site handle do not track signals?

We honor do not track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

Does our site allow third party behavioral tracking?

Subject to the provisions contained in this Policy, it is important to note that we allow third party behavioral tracking throughout the Actovia Properties.

Children Online Privacy Protection Act (COPPA)

When it comes to the collection of PII from children under 13, COPPA puts parents in control. The Federal Trade Commission, the nation’s consumer protection agency, enforces COPPA, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. Actovia does not specifically market to children under the age of 13.

INTERNATIONAL TRANSFERS

Please be aware that information we collect about you will be transferred for processing to countries or jurisdictions that may not have the same data protection laws as the country where you reside. By using any of the Actovia Properties, you consent to the transfer and storage of your personal information to any other country in which we or our service providers maintain facilities.

USER’S RIGHTS

If you no longer want to receive marketing-related material from us, you may opt-out of receiving these communications by following the unsubscribe instructions in such communications or by contacting us as indicated in the “Contact Us” section. We will try to comply with your request as soon as practicable. Please note that even though you have opted-out of receiving marketing-related communications from us, we may still send you important administrative messages.

Each user has the right to review, change, or suppress personal information that we have collected from that user. You may exercise this right by contacting us as indicated in the “Contact Us” section. For your protection, we may need to verify your identity before implementing your request. We will try to implement your request as soon as reasonably practicable. However, please note that we reserve the right to refuse to act on a request that is manifestly unfounded or excessive (for example because it is repetitive) and/or to charge a fee that takes into account the administrative costs for providing the information or taking the action requested.

In your request, please make clear what information you would like to have changed, whether you would like to have your personal information suppressed from our database, or other limitations you would like to put on our use of your personal information. We may only implement requests with respect to personal information that is associated with the particular email address that you use to send your request.
